California Consumer Privacy Act (CCPA) Notice
Introduction
This California Consumer Privacy Act Notice (“CCPA Notice”) supplements the general Privacy Policy of AlgoIndex and applies solely to individuals who are residents of the State of California. We issue this notice in compliance with the California Consumer Privacy Act (Cal. Civ. Code §1798.100 et seq.), as amended by the California Privacy Rights Act (collectively referred to here as “CCPA”), and other applicable California privacy laws. This CCPA Notice provides California residents with information about what personal information AlgoIndex collects and uses, how we use and disclose it, and the rights California residents have with respect to their personal information. It also includes our “Do Not Sell My Personal Information” disclosure and instructions for how you can exercise your right to opt out of the sale of your personal data. In this notice, “personal information” has the meaning given in the CCPA, and includes information that identifies, relates to, or could reasonably be linked with a particular California consumer or household.
Categories of Personal Information We Collect and Use
AlgoIndex may collect (and in the past 12 months, may have collected) the following categories of personal information from or about users for the business and commercial purposes described:
- Identifiers: Such as your name, email address, account username, postal address (if provided), phone number, or IP address. We use this information to create and manage your account, provide our services to you, communicate with you (e.g., sending updates or responding to inquiries), and for security and fraud prevention.
- Customer Records: If you purchase a product or service, we collect payment information (e.g., credit card numbers or payment token from our payment processor) and transaction history. We use payment and transaction data to process your orders, maintain proper financial records, and provide customer support. (Note: Payment details are typically handled via a third-party payment processor and not stored directly by AlgoIndex, except for basic transaction identifiers.)
- Commercial Information: This includes records of products or services you have purchased, obtained, or considered, as well as your usage history on AlgoIndex (such as which features you use or content you access). We use this to understand your interests, personalize your experience (for example, by suggesting content or features), and improve our offerings.
- Internet or Other Electronic Network Activity: Such as browsing history, search history, pages viewed, how you interact with our website, and the device and browser you use. We gather this through cookies and similar technologies (see our Cookie Policy) to analyze site traffic, measure the effectiveness of features or marketing campaigns, debug and resolve technical issues, and enhance your user experience.
- Geolocation Data: General location information may be derived from your IP address or billing information (e.g., city or country). We use location data to customize content (for example, showing relevant language or regional content), and to comply with legal requirements (such as tax calculation or regional privacy law compliance like GDPR/CCPA). We do not track precise GPS location unless you explicitly provide it for a specific service.
- Professional or Employment Information: (If you voluntarily provide it, for instance, in a survey or account profile) – such as your occupation or industry. We generally do not require this information, but if provided, we might use it to tailor certain communications or understand our user base demographics in aggregate.
- Inferences: We may draw inferences about your preferences or characteristics based on the other information we collect. For example, based on your site activity, we might infer which topics or algorithmic strategies you are interested in. We use these inferences to personalize your experience and marketing messages (where permitted) and to improve our products.
Purposes for Collecting Personal Information: We collect and use the above information for the following business purposes (as defined by the CCPA) and other internal purposes: to operate and maintain our services, to provide you with the products or content you request, to process payments and fulfill orders, to communicate with you about your account or transactions, to provide customer support, to personalize and improve our website and services, to debug and repair errors, to protect against malicious or fraudulent activity, and to comply with legal obligations (such as maintaining records or responding to lawful requests from authorities). We may also use some information for “commercial purposes” in the sense of improving our market strategy: for instance, to send you promotional communications about new features or products (you can opt out of marketing at any time), or to understand how users interact with ads or social media posts about AlgoIndex. We do not use sensitive personal information for purposes that, under the CCPA, would require offering a right to limit (we do not use or disclose sensitive data like precise geolocation, social security numbers, etc., beyond what is necessary for providing our services or as otherwise permitted by law).
Sources of Personal Information: We collect personal information directly from you (e.g., when you register an account, enter information on our site, or communicate with us), automatically through your use of our site (e.g., via cookies and web logs), and from third-party sources (e.g., if you use a third-party login like Google or LinkedIn to sign into AlgoIndex, or if we integrate a third-party tool that provides data on users’ interactions). We only obtain data from third parties that you have authorized or that are publicly available and relevant to your use of our services.
Disclosure of Personal Information: Under the CCPA, “disclosure” can include any sharing of personal information with third parties. In the past 12 months, AlgoIndex has disclosed certain categories of personal information to third parties for our business or operational purposes. The types of third parties to whom we disclose information include:
- Service Providers: We engage trusted companies to perform functions on our behalf in support of our operations. These include hosting providers, payment processors, analytics services, email service providers, customer support tools, and similar vendors. We share information with these service providers only as needed for them to render their services to us (for example, we provide your email address to our email delivery service to send account notifications or newsletters, or transaction data to our payment processor to process a purchase). Our service providers are contractually bound to protect your information and use it only for the purposes we specify.
- Affiliates: If AlgoIndex is part of a group of related companies (subsidiaries or affiliates under common ownership), we may share personal information within that corporate group for internal administrative purposes, such as centralized customer support or data processing. Any such affiliates will treat your information in accordance with privacy commitments similar to ours.
- Legal and Compliance: We may disclose personal information to outside parties when required to do so by law or legal process, or in response to valid requests by public authorities (e.g., in compliance with a court order, subpoena, or California Civil Code section 1798.130, if applicable). We may also disclose information if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of any person, or as evidence in litigation in which we are involved.
- Business Transfers: If we are involved in a merger, acquisition, sale of assets, bankruptcy, or other transaction where personal information may be transferred as part of the business assets, we will ensure the receiving party is bound by privacy obligations consistent with this notice. You will be notified via a prominent notice on our website or via email of any such change in ownership or control of your personal information.
- With Your Consent: We may disclose your personal information to any other third party with your explicit consent or at your direction. For example, if you participate in an AlgoIndex community forum or social media integration and you instruct us to share your information or content with other users or platforms, we will do so as directed by you.
Importantly, AlgoIndex does not sell your personal information for monetary consideration. The next section addresses “sale” and your related rights in more detail.
Your Right to Opt Out of Sale of Personal Information
California law gives you the right to opt out of the sale of your personal information. Under the CCPA, a “sale” is defined broadly to include not just exchanging data for money, but also sharing it for other valuable consideration (for example, making data available to third parties for advertising or profiling in exchange for some benefit). AlgoIndex does not sell personal information to third parties in the traditional sense (for money). We also do not share your personal information with third parties for their own direct marketing purposes without your consent. We primarily use your information internally and with service providers as described above.
However, to the extent that any sharing of data related to cookies or analytics could be construed as a “sale” under California law (for instance, if our site uses third-party analytics or advertising cookies that collect identifiers or internet activity in exchange for analytics insights or ad services), we want to give you the ability to opt out. We value your privacy choices. Therefore, we provide a “Do Not Sell My Personal Information” option to all users. If you are a California resident and wish to exercise your right to opt out of any potential sale of your personal information:
- Webform/Link: Please visit the “Do Not Sell My Personal Information” link located in the footer of our website (or accessible within your account settings or privacy preferences center). By clicking that link, you will be directed to our opt-out mechanism. Typically, this may be a form where you can submit a request, or a toggle that allows you to opt out of cookie-related data sharing.
- Email Request: Alternatively, you may opt out by sending an email to [email protected] with the subject line “Do Not Sell My Personal Information.” In the body, please clearly state that you request AlgoIndex not sell your personal information, and include your full name and the email associated with your AlgoIndex account (if you have one). This helps us identify you in our systems and process your request. You may also include any specific concerns or details, though that is optional.
- Authorized Agent: You may use an authorized agent to submit an opt-out request on your behalf. If you do so, we will take steps to verify that the person making the request is properly authorized to act on your behalf. For example, we may require a written authorization or proof of power of attorney, and we will also need either you or the agent to verify identity/authorization to a reasonable degree of certainty.
Once we receive your opt-out request, we will act upon it as required by law. For cookie-based opt-outs, we will endeavor to stop any non-essential third-party data transfers (note that you may need to adjust your browser settings to ensure opt-out preferences are stored, especially if you clear cookies frequently). For requests submitted via email or other methods, please allow us up to 15 business days to fully process the opt-out (CCPA requires an opt-out to be honored as soon as feasibly possible, but no later than 15 business days). We will confirm your opt-out has been processed by replying to your email or through an automated confirmation if you used the web form. After you have opted out, we will not sell your personal information unless you later provide authorization allowing us to do so.
If We Do Not Sell Data: For transparency, we reiterate that at this time AlgoIndex does not knowingly sell personal information of any user, including California residents, to third parties. In other words, we do not provide your personal details to other companies for money or for their independent use. In the event our practices change, we will update our Privacy Policy and this CCPA Notice accordingly and ensure that the required opt-out mechanisms are in place. We nevertheless maintain the Do Not Sell page and processes to give users peace of mind and a direct way to exercise their rights.
Other California Privacy Rights
The CCPA provides California residents with several additional rights regarding their personal information, subject to certain exceptions:
- Right to Know (Access): You have the right to request that we disclose what personal information we have collected, used, disclosed, and (if applicable) sold about you over the past 12 months. This includes the categories of personal information collected, the categories of sources, the business or commercial purposes for collecting it, the categories of third parties with whom we shared personal information, and the specific pieces of personal information we hold about you. Upon verification of a valid request, we will provide the information in a readily usable format, generally covering the 12-month period preceding your request (you may request beyond 12 months if applicable law allows, but note that our systems may not maintain data longer than necessary).
- Right to Delete: You have the right to request deletion of personal information we have collected from you and retained, subject to certain exceptions. For example, we may retain information needed to complete the transaction for which it was collected, to provide a service you requested, to detect security incidents, for legitimate internal business purposes such as debugging or accounting, to comply with a legal obligation, or other reasons allowed by the CCPA. If no exception applies, and once your deletion request is verified, we will delete (and instruct our service providers to delete) your personal information from our records. Where an exception applies, we will inform you of the retention that is necessary. Deleting your personal information may result in the closure of your AlgoIndex account and loss of access to services if the information was essential to providing those services.
- Right to Correct: (Effective January 1, 2023, under the CPRA amendments) You have the right to request the correction of inaccurate personal information that we maintain about you. If you identify that any personal details we have are incorrect or outdated (for example, an old email address or incorrect profile information), you can request that we rectify the error. After verifying your identity and the accuracy of the new information, we will correct our records and instruct any service providers or contractors to do the same, as required.
- Right to Limit Use of Sensitive Personal Information: The CCPA (as amended) grants consumers the right to limit certain uses of “sensitive personal information” (such as precise geolocation, social security numbers, etc.) if a business uses such information beyond what is necessary for providing goods or services. AlgoIndex does not use or disclose sensitive personal information for any purpose that triggers this right to limit (for instance, we do not use sensitive data for profiling or secondary purposes). Therefore, this right is not applicable to our operations at this time. If that changes, we will update our practices and honor applicable requests to limit use.
- Right of Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. This means we will not deny you goods or services, charge you a different price (or impose penalties), provide a different level or quality of service, or suggest any of these actions will occur because you exercised your rights under the CCPA. However, please be aware that if the exercise of your privacy rights limits our ability to process your personal information (for example, if you request deletion of your data), we may not be able to provide you certain services that rely on that information. In such cases, we will inform you of the service impact and any alternatives available. Any financial incentive or program (if we offer one in exchange for personal information, such as a discount or rewards program) will fully comply with CCPA’s requirements, meaning we will explain its terms and obtain your opt-in consent. You have the right to withdraw from such incentive programs at any time.
Exercising Your Rights
Submission of Requests: To exercise the Right to Know, Right to Delete, or Right to Correct, you (or your authorized agent) may submit a verifiable request to us through one of the following methods:
- Email: Send an email to [email protected] with the subject line “CCPA Request” and detail your request in the body. Please specify which right you wish to exercise (access, deletion, correction) and describe the nature of your request. For access requests, it is helpful if you state whether you want the “categories” of information or specific pieces of information, or both. For correction requests, clearly indicate which information is inaccurate and provide the correct information.
- Online Form: (If available) Visit the Privacy section of our website and use the interactive web form designated for CCPA requests. Fill in the requested details and submit the form electronically.
- Mail: You may send us a written request at our designated mailing address (if we maintain one for CCPA requests; see our general Privacy Policy or website for any physical contact addresses). Please include your full name, contact information, the nature of your request, and any relevant details that will help us fulfill your request. Mark the letter “Attn: Privacy Compliance – CCPA Request.”
Verification Process: For your protection, we will need to verify your identity (and authority, if through an agent) before processing a Right to Know, Delete, or Correct request. The information required may vary depending on your relationship with AlgoIndex and the sensitivity of the information involved. Generally, if you have an account with us, we can verify identity by matching sufficient information you provide in the request with the information we maintain (for example, verifying your name, email address, and perhaps asking you to confirm a recent transaction or other account details). If you do not have an account or if there is insufficient information to match, we may request additional proof of identity such as providing a government issued ID or other information. We will only use the information you provide for verification to verify and to process your request.
For authorized agents, we may require (1) proof of the agent’s identity, (2) proof of your identity (to a reasonable degree of certainty), and (3) a copy of the written authorization that gives the agent permission to act on your behalf, or a valid power of attorney. We may also contact you directly to confirm that the agent has permission to make the request on your behalf (unless you have provided a power of attorney pursuant to California Probate Code Sections 4000-4465).
Response Timing and Format: We will acknowledge receipt of your request within 10 days and provide information on how we will process it. We endeavor to substantively respond to verifiable consumer requests within 45 days of receipt. If we require more time (up to an additional 45 days, for a total of 90 days), we will inform you of the reason and extension period in writing. Our response will be delivered either through your account (e.g., secure inbox) or via email or mail, depending on what is appropriate. For Right to Know requests, we will either provide the requested information or explain the reasons we cannot comply (if applicable). For deletion requests, we will confirm deletion or explain the basis for denial (if we must retain certain data). For correction requests, we will confirm the information has been corrected or explain why we could not comply.
Any disclosures we provide will cover the 12-month period preceding the verifiable request’s receipt, or as otherwise required by law. If you request it, we may provide information beyond the 12-month period to the extent required by the CPRA (such as for data collected on or after January 1, 2022, in certain cases). We do not charge a fee for processing your request unless it is excessive, repetitive, or manifestly unfounded (in which case we may charge a reasonable fee or refuse to act on the request, as permitted by law). If a fee is necessary, we will explain why and provide a cost estimate before completing the request.
Do Not Sell Opt-Out Requests: As noted, opt-out requests are processed on a faster timeline (typically within 15 business days). If you have opted out of the sale of your personal information, we will wait at least 12 months before asking you if we may resume selling your data (per CCPA rules). You can also opt back in at any time by contacting us to expressly consent.
Financial Incentives: At this time, AlgoIndex does not offer any programs that provide financial incentives (such as discounts or rewards) in exchange for the collection or retention of personal information. Should we introduce such a program, we will update this CCPA Notice to explain the material terms of the incentive, what data is involved, and how you can opt in or withdraw, as required by law. Participation in any such program will be based on your prior opt-in consent, which you may revoke at any time.
